EDAC Labs  has prepared this Privacy Notice to describe to you how EDAC Labs collects, uses, discloses and protects the personal information that we may collect about you and other end users (“Users”), and the choices you have with respect to your personal information, in connection with our website, edaclabs.com ("Website").

While viewing our website (specifically the "news" page, you may be directed to linked articles on websites that are operated by third parties. We have no control over these third parties and we are not responsible for the privacy practices of such third parties. This Privacy Notice does not apply to information collected by any other website or third party, or to any information collected by third parties through any application or content (including advertising) that may link to or be accessible from our Services. You should carefully review the privacy policy for any third party sites that you visit.

PERSONAL INFORMATION YOU PROVIDE (via Contact page or social links). 

EDAC Labs collects personal information when you voluntarily submit it to us via our Contact page. For example, we may collect or receive personal information when a User: signs up to receive our newsletters (coming in future), submits Contact form, interacts with our social media pages; or otherwise interacts with us at an event, over the phone or video conference, through email or text, or through other communication channels. 

APPLICANT DATA (via Careers page)

We want you to know how we collect, use, and disclose your personal information in connection with your application for employment with us.  If you reside in California, please see the California Resident Applicant Privacy Rights section below, which supplements other information found in this Privacy Notice. This Applicant Privacy Notice does not create or form part of any employment contract or otherwise. Alternative formats of this Applicant Data Privacy Notice are available to individuals with a disability.  Please contact careers@edaclabs.com for assistance.

When you engage with Careers or apply to a job on this site, the personal data contained in your application will be collected by EDAC Labs. By submitting your personal information to EDAC Labs, you are confirming your express consent for this data to be processed by EDAC Labs and its subprocessors as part of your application for employment. You may contact EDAC Labs by emailing careers@edaclabs.com. 

Your personal data will be shared with EDAC Labs' subprocessor AshbyHQ Software, Inc., a cloud services provider located in the United States of America and engaged by EDAC Labs to help manage its recruitment and hiring process on EDAC Labs' behalf. Accordingly, if you are located outside of the United States, your personal data will be transferred to the United States once you submit it through this site. Any transfer to AshbyHQ Software, Inc. will be covered by the 2021 Standard Contractual Clause transfer mechanism in compliance with EU safeguards.

The following indicate the categories of personal information as part of applicant data collection. These categories of information are used for the purposes of managing EDAC Labs' recruitment related activities, which include setting up and conducting interviews and tests for applicants, evaluating, and assessing the results thereto, and as is otherwise needed in the recruitment and hiring processes.

1. Identifiers, for example: real name, nickname, telephone number, postal address, e-mail address, signature, social security number, government-issued identification information (e.g., driver’s license, passport), photographs, social media handles, or other similar identifiers. 
2. Professional or Employment-Related Information, for example: Biographical information, such as name, professional history, references, professional qualifications, references, and information you make publicly available through job search or career networking sites; Job applicant materials, such as your job application, resume or CV, cover letter, whether you are subject to prior employer obligations, and information that referrers provide about you, and information necessary to complete background checks, and other screens permitted by law. Job preferences, such as desired position, compensation, location, and willingness to relocate.
3. Characteristics of Protected Classifications Under State or Federal Law for Applicants, for example: race, age, national origin, disability, sex, sexual orientation, veteran status, immigration status to verify employment eligibility, and information needed to evaluate accommodation requests regarding potential disabilities or other health conditions. Such information is collected on a purely voluntary basis, except where collection is required by law, and used only in compliance with applicable laws and regulations, and for diversity and inclusion reporting and related purposes. Such information is separated from the hiring decision process and diversity data is analyzed on anonymized or deidentified basis.

• To conduct a pre-employment criminal history background check

Use of Applicants' Protected Categories Of Information

EDAC Labs collects information about race, age, national origin, disability, sex, and veteran status for purposes of 

• monitor diversity analytics
• to comply with legal obligations
• reporting requirements (including reporting requirements of the federal Equal Employment Opportunity Act, The Office of Federal Contracting Compliance Programs)
• To accommodate disabilities or health conditions

EDAC Labs complies with all applicable state, federal and local laws respecting consideration of unemployment status in making hiring decisions.

How long we keep Applicants’ personal information

We will retain your Personal Information as long as required to fulfill the purpose(s) for which this information was collected, comply with our legal obligations, resolve disputes, and enforce our contractual agreements, or as necessary for our legitimate interests, such as to consider you for other current and future employment opportunities and to help us improve our recruitment processes. If you do not want us to retain your Personal Information for consideration for other roles, or want us to update it, please contact us at careers@edaclabs.com. If hired by EDAC Labs, some of your applicant Personal Information will be kept in your personnel file. Irrelevant data may be deleted after a short period.

California Resident Applicant Privacy Rights

For California residents in the context of the CCPA, EDAC Labs does not receive any personal information as defined in the CCPA (“CCPA Personal Information”) as consideration. EDAC Labs will not collect, sell, or use the CCPA Personal Information except as necessary to process your application for employment with EDAC Labs. EDAC Labs does not sell and has not sold CCPA Personal Information within the preceding 12 months, as “sale” is defined in the CCPA. Further, we do not knowingly “sell” or “share” the personal information of California residents under 16 years of age. 

To the extent we collect sensitive personal information (as defined under California law), we only use or disclose it for purposes permitted under California law (e.g., to perform HR activities such as payroll and benefits, monitor for security incidents, and for compliance and safety purposes). We do not collect or use sensitive personal information for the purpose of inferring characteristics about California candidates.

This Section applies only to Applicants who are residents of the state of California.

California applicants may exercise the rights listed below. However, these rights are not absolute, and in certain cases we may not be able to respond to your request, such as when a legal exemption applies or if we are not able to verify your identity.

• Know/Access.  You can request the following information about how we have collected and used your personal information:
  • the categories of sources from which we collected personal information.
  • the categories of personal information that we have collected.
  • the business or commercial purpose for collecting, selling, or sharing (if applicable) personal information.
  • the categories of third parties with whom we disclose personal information.
  • a copy of the personal information that we have collected about you.
• Delete.  You can ask us to delete the personal information that we have collected from you.
• Correct.  You can ask us to correct inaccurate personal information that we maintain about you.
• Nondiscrimination.  You are entitled to exercise the rights described above free from discrimination.

How to Exercise Your Rights

EDAC Labs will respond to requests to know, delete, and correct in accordance with applicable law if it can verify the identity of the individual submitting the request. You can exercise these rights in the following ways by contacting careers@edaclabs.com

How We Will Verify Your Request:

The processes that we follow to verify your identity when you make a request to know, correct, or delete is to verify the email address that you used when you applied for a role.

We have implemented the following additional procedures when verifying the identity of requestors:

1. If we cannot verify your identity based on the processes described above, we may ask you for additional verification information.  If we do so, we will not use that information for any purpose other than verification.
2. If we cannot verify your identity to a sufficient level of certainty to respond to your request, we will let you know promptly and explain why we cannot verify your identity.

Authorized Agents

If an authorized agent submits a request to know, correct, or delete on your behalf, the authorized agent must submit with the request a document signed by you that authorizes the authorized agent to submit the request on your behalf.  In addition, we may ask you or your authorized agent to follow the applicable process described above for verifying your identity. You can obtain our “Authorized Agent Designation” form by contacting us.

Non-Discrimination and Non-Retaliation Notice 

EDAC Labs will not unlawfully discriminate or retaliate against you for exercising your privacy rights under the California Privacy Rights Act.
